What changes about your US taxes when you retire to Ireland

You keep your US filing obligation after moving to Ireland from the US. The United States taxes its citizens on worldwide income wherever they live, and the same filing thresholds apply abroad as at home. Cross one and you file a 1040.

Everything around it changes. Ireland taxes you once you are resident there, and the treaty sets which country taxes each kind of income. Your Irish accounts count toward the US foreign account reporting thresholds, and your filing dates change.

For Americans retiring in Ireland, you file the first year abroad twice, once in each country. We start with that year.

US tax filings we handle from Ireland

  • Your 1040 from abroad.

We use the automatic June 15 extension where you qualify for it, and request the October extension where you need longer. Tax owed is still due in April, and the IRS charges interest from then.

  • FBAR and FATCA reporting.

FinCEN Form 114 for foreign accounts over the aggregate threshold, and Form 8938 where your assets exceed the higher limits for filers abroad.

  • Treaty positions and foreign tax credits.

Form 1116 to claim credit for Irish tax paid or accrued, and the treaty article that applies to each income type you hold.

  • Pension, IRA and Social Security planning.

What a distribution costs you once Ireland has a claim on it, and how the totalization agreement combines your US and Irish work credits.

Stamp 0 and Irish tax residency

Immigration residency.

The Ireland retirement visa is Stamp 0, an immigration permission rather than a visa. It is for people who can support themselves without working in Ireland and without drawing on public funds. Ireland grants it for a limited period and renews it. Your tax position is separate from it.

Tax residency.

Ireland treats you as resident if you spend 183 days or more there in a tax year, or 280 days across that year and the one before it. If you spend 30 days or fewer in a year, Ireland ignores the second test for that year. The Irish tax year is January to December, so it may not match your Stamp 0 period.

How Ireland taxes US pensions and Social Security

Once you are Irish resident, each kind of US retirement income is taxed differently, and the US-Ireland treaty sets the split:

IncomeIrelandUnited States
US Social SecurityTaxes it in full, whether or not you bring it in (Article 18(1)(b))Does not tax it; the treaty's saving clause makes an exception here
Private pension, IRA or 401(k) distributionsTaxes them as your country of residence (Article 18(1)(a))Taxes them too, because you are a citizen
Other US income and gains you keep abroadTaxes only what you bring into Ireland, while you stay US-domiciledTaxes them

Spending US income in Ireland counts as bringing it in. You can bring in capital you held before you became resident without Irish tax.

Plan your taxes before moving to Ireland

Start the tax planning before you go. Retirement in Ireland for US citizens means deciding before departure what you keep, what you sell and what you move. Tell us your departure date, your income sources and whether you will move any retirement account.

Does the foreign earned income exclusion cover pension income

No. The IRS limits the Foreign Earned Income Exclusion to income from services, which means wages and self-employment. It puts pensions, annuities, Social Security benefits, dividends, interest and capital gains in the unearned column. If you are living on a pension and a portfolio, none of it qualifies.

Where both countries tax the same income, a foreign tax credit can reduce your US tax. You claim qualifying Irish tax when paid or accrued, depending on your accounting method and any election.

What affects the cost of US tax filing from Ireland

We quote from four factors:

  • The number of income sources taxed in both countries.

  • Whether you hold foreign accounts, and how many.

  • Whether your last state still requires a return.

  • Whether prior years need catching up before we file this one.

A single pension, one Irish bank account and no state return is the light end. These are the factors, not a quote.
